Action by the town of Brookfield to have an ordinance enacted by the city council of the city of Brookfield annexing certain territory in the town to the city declared null and void. The validity of the ordinance was challenged on two grounds: First, that the petition on file with the city council at the time it enacted the annexation ordinance was not properly signed by a majority of the electors within the territory proposed to be annexed; second, that the area proposed to be annexed possesses none of the characteristics of a city and that said area is not suitable or adaptable to city uses or needs, and that it is not necessary for the future growth, development and welfare of the city. Judgment was entered on July 11, 1956, declaring the ordinance void on the first ground advanced by the town. On the second ground the judgment included a determination by the trial court that the characteristics of the area proposed for annexation and the fact that said area at the present time is not necessary for the growth, development and welfare of the city are immaterial and irrelevant in an annexation proceeding. The city appealed from the judgment and the town moved for a review of the determination of the trial court on its second ground.
